Transcript: Hi my name is Curt Runger I’m an attorney in Memphis, Tennessee and I help my clients navigate through the oftentimes difficult divorce process by protecting what is most important to them: their minor children and their assets. One commonly asked question that arises in contested divorces with custody disputes is, what is a guardian ad litem and what is the role of a guardian Litem? So, a guardian ad litem is an attorney that the judge in your divorce case, but points to be independent and unbiased and to conduct an investigation. Regarding the respective parents positions with respect to custody for their minor children. So guardian ad litem will oftentimes meet with both parents they may do home studies, they’ll interview the parents guardian ad litem will also oftentimes talk to the minor children. And when appropriate, guardian ad litem will speak to children psychologist or even psychologists for mother and father are counselors and essentially at the end of the investigation. The guardian ad litem will prepare a report and submit the report to the judge for the judge to utilize in the judges evaluation of custody in the case. Now, everything that the guardian ad litem does in terms of recommendations to the court on custody is supposed to be, what is in the best interest of the minor children. So as a neutral, their primary concern is figuring out what kind of custody arrangement is going to be in the best interest of the minor children.
